Sheriff Asa Buck
CARTERET COUNTY – There is no provision to charge a person for simply failing to wear a face covering in public. The areas of enforcement only pertain to businesses, certain government and transportation settings. Citations under this order would be issued only to businesses or organizations that fail to enforce the face covering requirement.
Law enforcement personnel are not authorized to enforce the requirement against individual workers, customers or patrons. However, if a business does not allow entry to a customer or patron because that person refuses to wear a face covering, and if that person enters the premises or refuses to leave the premises, law enforcement officers may enforce trespassing laws.
The Sheriff’s Office encourages everyone to take safeguards to protect themselves, their families, friends, and neighbors. As a practical matter it would be difficult to enforce the face covering requirements of the Governor’s order based on the way the order is worded and the numerous exceptions present in the order; therefore, my Office will not be enforcing the face covering requirements of Executive Order No 147.
A business owner or person in control of an establishment has the right to refuse entry or service to a customer and has the right to ask a person to leave their premises. My office will enforce the criminal trespassing laws if required.
It is my hope that no person pushes the issue to the point that law enforcement would need to be contacted and we would attempt to resolve any trespassing matter without criminal charges unless necessary.
Thank you, always, for your continued support.

I'm disappointed in Asa Buck's statement concerning trespass citations and/or..... I have difficulty breathing and should not get a trespass from a business for not wearing a mask....Period!

Its the only thing he can do! I stand behind him. He has to walk a fine line. You are in the exceptions medical reasons are excluded. All you have to say is you have a medical condition and they cannot hold you back from entering. I have Heart issues and breathing issues too. Look it up on the states site. If anyone asks you for your medical reasons you do not have to state what they are and if they violate you is is punishable under the Hipaa rules and Americans with disabilities act. They can get big time fines for it. So go mask less.

Multiple N.C. Sheriffs Refuse to Enforce Governor's Mask Requirement

By Spectrum News Staff Halifax County

NORTH CAROLINA – The Sheriffs of Halifax, Alamance, Sampson, Washington, and Beaufort Counties say they will not be enforcing the governor’s mask requirement.

People with health issues/breathing issues who have a hard time wearing a mask are exempt from the wearing a mask. The same goes for people/children who have issues such as autism where they cannot handle wearing one. It's ludicrous for the governor to ask businesses to enforce mask wearing.

Suddenly everyone is disabled !

a lot of you may not have to worry about wearing a mask if this mess keeps on coming on strong as it has over the past few weeks.

No one leaves this earth alive , except astronauts and some of them failed at that , the only choice you may have is how . Even that is not gospel . I for one an not quite ready so I’ll opt for a mask . Not all the time and every where but I will be packing one for when I deem it needed . So there !

Thanking us for our "continued support" is a bit presumptuous Sheriff Buck. You might want to reconsider your stance on this mask business.
